Thank you for choosing Cross Digital Ltd.

This Agreement is made between Cross Digital Ltd, a provider of IT support services and has reasonable skill, knowledge, qualifications and experience in that field ("Service Provider"), and any party that engages Cross Digital Ltd’s services ("Client"). By accessing and utilising Cross Digital Ltd’s services, the Client agrees to be bound by the terms and conditions outlined in this Agreement.

Definitions and Interpretation 

In this Agreement, unless the context otherwise requires, the following expressions have the following meanings:

  • Business Day: means, any day (other than a Saturday or Sunday) on which ordinary banks are open for their full range of normal business in the United Kingdom;
  • Business Hours: means 09:00–17:30 Monday to Friday UK time (excluding public holidays).
  • Agency: means Cross Digital Ltd.
  • Confidential Information: means, in relation to either Party, information which is disclosed to that Party by the other Party pursuant to or in connection with this Agreement (whether orally or in writing or any other medium, and whether or not the information is expressly stated to be confidential or marked as such);
  • Data Protection Legislation: means all applicable legislation in force from time to time in the United Kingdom applicable to data protection and privacy including, but not limited to, the UK GDPR (the retained EU law version of the General Data Protection Regulation ((EU) 2016/679), as it forms part of the law of England and Wales, Scotland, and Northern Ireland by virtue of section 3 of the European Union (Withdrawal) Act 2018); the Data Protection Act 2018 (and regulations made thereunder); and the Privacy and Electronic Communications Regulations 2003 as amended;
  • Fees: means the fees payable by the Client to the Service Provider in consideration of the Services as fully described in Schedules;
  • Parties: The entities or individuals bound by this Agreement, collectively referred to as Cross Digital Ltd (the "Service Provider") and the Client. The term "Party" refers to either Cross Digital Ltd or the Client individually, depending on the context.
  • Services: means the services to be provided by the Service Provider to the Client.
  • Term: means the term of this Agreement as defined in Clause 9; and
  • We/Us/Our: means Cross Digital Ltd, a company registered in England and Wales. under company number 10157215 whose registered Office is at 1 Highcroft Court, Exeter, Devon, EX4 4RW
  • You: means the Client. 

2. Service Provider’s Obligations

2.1 The Service Provider shall use reasonable endeavours to provide the Support Services in accordance with the agreed services and pricing tier in all material respects.
2.2 The Service Provider shall provide the Support Services with reasonable skill and care.
2.3 The Service Provider shall use reasonable endeavours to meet deadlines agreed from time to time with the Client, but any such dates shall be estimates only.  Time for performance shall not be of the essence of this Agreement.
2.4 The Service Provider shall use reasonable endeavours to act in accordance with all reasonable instructions given to it by the Client, provided such instructions are compatible with the scope of the Support Services as set out in the agreed services and pricing tier.
2.5The Service Provider shall be responsible for ensuring that it complies with all statutes, regulations, byelaws, standards, codes of conduct, and any other rules relevant to the provision of the Support Services.
2.6The Service Provider shall use reasonable endeavours to accommodate any reasonable changes in the Support Services that may be requested by the Client, subject to the Client’s acceptance of any reasonable changes to the Fees that may be due as a result of such changes.

5. Children

5.1.  Our products are not aimed at people under the age of 16.  We would not knowingly sell our products or services to anyone under the age of 16 without the consent of a parent or guardian.​​

6. Terms and Conditions for Online Applications

a. Data Privacy:
By submitting your application through our online form, you consent to our collection, storage, and use of the personal information provided by you as described in our Privacy Policy. We will process your data exclusively for recruitment purposes, evaluating your suitability for the role for which you are applying, and managing your relationship with us. Your personal information will be kept confidential and secure, and it will not be shared with third parties without your explicit consent, except as necessary to comply with legal obligations.

b. Accuracy of Information:
You declare that all information submitted in your application is accurate, complete, and true. You acknowledge that providing false or misleading information during any stage of the application process may lead to your application being rejected or, if discovered after employment commences, to disciplinary action or dismissal.

c. Communication Consent:
You agree to accept communications from us regarding your application and other employment-related matters, which may include but are not limited to, emails, telephone calls, and text messages.

d. Acceptance of Terms:
By clicking “Submit” on the application form, you confirm that you have read, understood, and agree to these terms and conditions. You acknowledge that these terms form part of the agreement between you and [Your Company Name] regarding your application.

7. CHOICE OF LAW

7.1. Our website and these terms and conditions shall be governed by English law and subject to the exclusive jurisdiction of the English Courts.
